Terms of Service

These Terms of Service (“Terms”) govern your use of the Littlebird website, accounts and booking tools (the “Service”). Littlebird is a d/b/a of ATI Jet Inc., which also does business as Jetvia (“we”, “us”, “our”). By creating an account, requesting a quote or booking a flight you agree to these Terms. If you don’t agree, please don’t use the Service.
1. What the Service is
The Service lets you see prices for on-demand private charter flights, request and book trips, pay for them, and manage your trips, travelers and account funds. Flights are operated by FAA Part 135 air carriers (ATI Jet Inc. d/b/a Jetvia, or another Part 135 operator named on your booking), which keep operational control of every flight. Each booking is also governed by the Charter Agreement & Cancellation Policy you accept at checkout. If these Terms and the Charter Agreement conflict about a flight, the Charter Agreement controls.
2. Eligibility and your account
- You must be at least 18 years old and able to enter into a binding contract.
- Give us accurate, complete information — including legal names exactly as they appear on government ID, which we need for passenger manifests — and keep it up to date.
- Keep your sign-in details secure. You are responsible for activity on your account. Tell us right away at [email protected] if you think someone else has used it.
- If you book for someone else, or add a planner to manage your trips, you confirm you have their permission and that they agree to these Terms and the Charter Agreement. Planners act on behalf of the traveler who invited them.
3. Quotes, bookings and requests
- Quotes are estimates based on planned flight times, aircraft availability and the fees in effect when you search, and they expire after a set time. A quote is not a reservation.
- Some trips can be booked instantly and are confirmed when payment succeeds. Others are requests: your payment method is authorized but not charged until we approve the trip. We may decline any request.
- Prices can change before checkout if aircraft availability changes; we’ll show you the new price before you pay.
- All flights are subject to aircraft and crew availability, weather, maintenance, airport conditions and the pilot-in-command’s judgment, as set out in the Charter Agreement.
4. Payments, account credit and deposits
- Payments are processed by our payment provider, Stripe. By paying you authorize us to charge (or place a hold on) your payment method for the trip price and any Additional Charges described in the Charter Agreement.
- Credit cards may carry a card fee, shown to you before you’re charged. Debit and prepaid cards do not.
- Account credit is promotional, issued at our discretion, has no cash value and can’t be refunded, transferred or exchanged for money.
- Deposits are funds you send by wire or ACH to the account number shown in your account. They stay yours until a booking uses them, and you can ask for any unused deposit back to your bank.
- Coupons are subject to the conditions shown with them and can be withdrawn at any time.
5. Changes and cancellations
Changes and cancellations of booked flights, and any refunds, are governed by the cancellation policy in the Charter Agreement. Contact us at [email protected] or +1 (512) 641-1367 as soon as your plans change.
6. Acceptable use
You agree not to: misuse the Service or try to access it other than through the interfaces we provide; scrape, copy or resell our prices or content; interfere with its security or operation; book with a payment method you aren’t authorized to use; or use the Service for anything unlawful or for any person who is the subject of sanctions or a travel ban.
7. Our content
The Service, including its software, text, photos, logos and the Littlebird and Jetvia names, belongs to us or our licensors. You may use it only to plan and book travel with us.
8. Communications
We’ll send you emails about your account, bookings, payments and deposits; these are part of the Service. Your pilot or our team may also call or text the phone number on your account about your trips. We’ll only send marketing messages as the law allows, and you can opt out of them at any time.
9. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law we make no warranties, express or implied, about the Service, including that it will be uninterrupted, error-free or that quotes will always be available. Nothing in these Terms limits any rights you have that can’t be limited under law.
10. Limitation of liability
To the fullest extent permitted by law, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or lost profits or data, arising from your use of the Service. Our total liability for any claim about the Service (as opposed to a flight, which the Charter Agreement covers) is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
11. Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Service.
12. Suspension and closing your account
We may suspend or close accounts that break these Terms or put others at risk. You can close your account at any time by contacting us; bookings already made remain subject to the Charter Agreement, and any unused deposit will be returned to you.
13. Governing law
These Terms are governed by the laws of the State of Texas. Any dispute will be brought exclusively in the state or federal courts located in El Paso, Texas.
14. Changes to these Terms
We may update these Terms from time to time. We’ll post the new version here with its date, and tell you about material changes by email or on the site. Continuing to use the Service after a change means you accept it.
